医療倫理は医療の中で倫理的問題の解決への指針となる原則です。原則とは、「他の多くの道徳的規準および判断の基礎となる根本的な行動基準」です。原則は、意のままに無視できるような経験則ではないが、絶対的な拘束力をもつものでもなく、他の原則と対立しない限り常に拘束力をもつ一応の義務であるとされます。原則に訴えて医療や健康政策における倫理問題を解決しようとする方法を、原則中心主義といいます。慶友銀座クリニックは医療倫理の4つの原則、医療専門職の義務の基礎となる二つの原則に基づいて医療行います。

医療倫理の四つの原則
①自律尊重原則:自律(Autonomy)とは、「自由かつ独立して考え、決定する能力」であり、また「そのような考えや決定に基づいて行為する能力」です。臨床場面において、患者の自律を尊重することとは、患者が自分で決定できるよう、重要な情報の提供、疑問への丁寧な説明などの援助をおこない、患者の決定を尊重し従うことを、医療専門職および患者の家族など、患者に関わる周囲の人々に対して求めていることを意味します。
②善行原則(Beneficence: the promotion of what is best for the patient):この原則は、「患者に対して善をなすこと」である。特に医療の文脈においてこの原則に従うことは、患者のために最善を尽くすことを要求していると言えます。そこで、患者をケアする医療専門職は客観的な評価によって、その患者の最善の利益を決定することに意を注ぎ取り組む、と解釈され易い。しかし、患者の最善の利益とは、医療専門職の考える患者にとっての最善の利益をさすのではなく、その患者の考える最善の利益をも考慮することを意味します。
③無危害原則(Non-maleficence: avoiding harm):この原則は、善行原則と連動した意味合いをもち、「人に対して害悪や危害を及ぼすべきではない」とされます。この原則から、1) 「危害を引き起こすのを避ける」、2) 「害悪や危害を及ぼすべきではない」という責務が導かれます。医療専門職の無危害の責務を考えたとき、危害を加えない責務および危害のリスクを背負わせない責務を含むと言うことができます。
④正義原則(Justice):正義とは、正当な持ち分を公平に各人に与える意思を言い、正義原則とは、「社会的な利益や負担は正義の要求と一致するように配分されなければならない」ものを言います。この正義原則における分配には、1) 形式的な正義 - 類似した状況にある患者は、同様の医療を受けられるべきである - 、2) 実質的な正義 - ある患者集団に利用可能な医療レベルを決める際には、その患者集団のどのような違いに応じて決められるべきか - があります。臨床現場においては、最善の可能な医療資源(集中治療室のベッド、災害医療時の医療資源など)をすべての人に提供できるわけではありません。医療システムなど様々な状況の中で、医療専門家は、個々の患者に費やすことができる資源の範囲、提供できる治療の限界について判断することを求められているのです。

医療専門職の義務の基礎となる二つの原則
①誠実(Veracity):誠実の原則とは、「真実を告げる、うそを言わない、あるいは他者をだまさない義務」というものである。人に対して正直であることは、医療現場における信頼関係を構築する上で、特に重要です。なぜなら、患者との信頼関係なしに、治療効果やケアの効果を期待することは不可能であるからです。
②忠誠(Fidelity):忠誠の原則とは、「人の専心したことに対して誠実であり続ける義務」というものです。医療従事者にとって患者からの情報提供なしに、最善の治療を勧めることはできません。忠誠の中に含まれる専心や献身さ、確約は、看護師と患者間の信頼関係に潜在しており、医療専門職の義務である守秘義務や約束を守るという規則の基礎となるものなのです。

病人役割と医師役割
医師に果たすべき役割があるように、患者にも果たす役割が期待され、これらは互いに異なる権利と義務をもっている。 病人役割は、通常の社会的役割遂行の義務と 自力で回復する義務を免除される権利を得る代わりに、病気を望ましくない状態と認めて回復しようとする義務と、健康回復のために医療専門職に援助を求めて協力する義務を負うことを期待されている。一方、医師役割としては、医師は自己の私利私欲を優先させることなく、そのときの最善の治療法を適応させて最善を尽くす義務を負う。このため医師は、医学上の専門知識と技術とを身につけて、それを絶えず更新する義務も負うことになる。また権利としては、問題の疾病に関連した患者の最も私的な秘密の情報を獲得する権利や、患者の信頼を確保する権利が認められる。

以上を含め慶友銀座クリニックでは倫理綱領を定めました。

◎医師や医療従事者には「裁量権」があります。これは、臨床医学が持つ本質的不確かさより起こる事柄に対して、学識経験に基づき判断し診療行為を行うことです。
◎患者さんからの要求が「自らの良心や価値観」に反する場合、医師や医療従事者はこれに応じない権利を有します。
◎患者さんは「患者の権利」を有しますが、権利には、義務と責任が伴います。

慶友銀座クリニックはヒポクラテスの誓いを守ります。

ヒポクラテスとは紀元前460年頃,ギリシアのコス島の生まれで,医神,医聖とも言われ尊敬されている人物です。ギリシアの哲学者ソクラテスとほぼ同時代の人物です。それまでの呪術的医療と異なり、健康・病気を自然の現象と考え、科学に基づく医学の基礎を作ったことで「医学の祖」と称されています。

Hippocratic Oath

The Oath of Hippocrates

 I swear by Apollo the Physician, and Aesculapius, and Health, and All-heal, and all the gods and goddesses, that, according to my ability and judgment, I will keep this oath and this stipulation-to reckon him who taught me this art equally dear to me as my parents, to share my substance with him, and relieve his necessities if required; to look upon his offspring in the same footing as my own brothers, and to teach them this art, if they shall wish to learn it, without fee or stipulation; and that by precept, lecture, and every other mode of instruction, I will impart a knowledge of the art to my own sons, and those of my teachers, and to disciples bound by a stipulation and oath according to the law of medicine, but to none others. ヒポクラテスの誓い

 医神アポロン、アスクレピオス、ヒギエイア、パナケイアおよびすべての男神と女神に誓う。私の能力と判断にしたがってこの誓いと約束を守ることを。
1.この術を私に教えた人をわが親のごとく敬い、わが財を分かって、その必要あるとき助ける。

7.いかなる患家を訪れる時もそれはただ病者を益するためであり、あらゆる勝手な戯れや堕落の行いを避ける。女と男、自由人と奴隷の違いを考慮しない。
8.医に関すると否とにかかわらず他人の生活について秘密を守る。

Preamble
1. The World Medical Association (WMA) has developed the Declaration of Helsinki as a statement of ethical principles for medical research involving human subjects, including research on identifiable human material and data.
The Declaration is intended to be read as a whole and each of its constituent paragraphs should be applied with consideration of all other relevant paragraphs.
2. Consistent with the mandate of the WMA, the Declaration is addressed primarily to physicians. The WMA encourages others who are involved in medical research involving human subjects to adopt these principles.

General Principles
3. The Declaration of Geneva of the WMA binds the physician with the words, "The health of my patient will be my first consideration," and the International Code of Medical Ethics declares that, "A physician shall act in the patient's best interest when providing medical care.
4. It is the duty of the physician to promote and safeguard the health, well-being and rights of patients, including those who are involved in medical research. The physician's knowledge and conscience are dedicated to the fulfilment of this duty.
5. Medical progress is based on research that ultimately must include studies involving human subjects.
6. The primary purpose of medical research involving human subjects is to understand the causes, development and effects of diseases and improve preventive, diagnostic and therapeutic interventions (methods, procedures and treatments). Even the best proven interventions must be evaluated continually through research for their safety, effectiveness, efficiency, accessibility and quality.
7. Medical research is subject to ethical standards that promote and ensure respect for all human subjects and protect their health and rights.
8. While the primary purpose of medical research is to generate new knowledge, this goal can never take precedence over the rights and interests of individual research subjects.
9. It is the duty of physicians who are involved in medical research to protect the life, health, dignity, integrity, right to self-determination, privacy, and confidentiality of personal information of research subjects. The responsibility for the protection of research subjects must always rest with the physician or other health care professionals and never with the research subjects, even though they have given consent.
10. Physicians must consider the ethical, legal and regulatory norms and standards for research involving human subjects in their own countries as well as applicable international norms and standards. No national or international ethical, legal or regulatory requirement should reduce or eliminate any of the protections for research subjects set forth in this Declaration.
11. Medical research should be conducted in a manner that minimises possible harm to the environment.
12. Medical research involving human subjects must be conducted only by individuals with the appropriate ethics and scientific education, training and qualifications. Research on patients or healthy volunteers requires the supervision of a competent and appropriately qualified physician or other health care professional.
13. Groups that are underrepresented in medical research should be provided appropriate access to participation in research.
14. Physicians who combine medical research with medical care should involve their patients in research only to the extent that this is justified by its potential preventive, diagnostic or therapeutic value and if the physician has good reason to believe that participation in the research study will not adversely affect the health of the patients who serve as research subjects.
15. Appropriate compensation and treatment for subjects who are harmed as a result of participating in research must be ensured.

Risks, Burdens and Benefits
16. In medical practice and in medical research, most interventions involve risks and burdens.
Medical research involving human subjects may only be conducted if the importance of the objective outweighs the risks and burdens to the research subjects.

17. All medical research involving human subjects must be preceded by careful assessment of predictable risks and burdens to the individuals and groups involved in the research in comparison with foreseeable benefits to them and to other individuals or groups affected by the condition under investigation.
Measures to minimise the risks must be implemented. The risks must be continuously monitored, assessed and documented by the researcher.

18. Physicians may not be involved in a research study involving human subjects unless they are confident that the risks have been adequately assessed and can be satisfactorily managed.
When the risks are found to outweigh the potential benefits or when there is conclusive proof of definitive outcomes, physicians must assess whether to continue, modify or immediately stop the study.

Vulnerable Groups and Individuals
19. Some groups and individuals are particularly vulnerable and may have an increased likelihood of being wronged or of incurring additional harm. All vulnerable groups and individuals should receive specifically considered protection.

20. Medical research with a vulnerable group is only justified if the research is responsive to the health needs or priorities of this group and the research cannot be carried out in a non-vulnerable group. In addition, this group should stand to benefit from the knowledge,practices or interventions that result from the research.

Scientific Requirements and Research Protocols
21. Medical research involving human subjects must conform to generally accepted scientific principles, be based on a thorough knowledge of the scientific literature, other relevant sources of information, and adequate laboratory and, as appropriate, animal experimentation. The welfare of animals used for research must be respected.
22. The design and performance of each research study involving human subjects must be clearly described and justified in a research protocol.
The protocol should contain a statement of the ethical considerations involved and should indicate how the principles in this Declaration have been addressed. The protocol should include information regarding funding, sponsors, institutional affiliations, potential conflicts of interest, incentives for subjects and information regarding provisions for treating and/or compensating subjects who are harmed as a consequence of participation in the research study.

In clinical trials, the protocol must also describe appropriate arrangements for post-trial provisions.

Research Ethics Committees
23. The research protocol must be submitted for consideration, comment, guidance and approval to the concerned research ethics committee before the study begins. This committee must be transparent in its functioning, must be independent of the researcher, the sponsor and any other undue influence and must be duly qualified. It must take into consideration the laws and regulations of the country or countries in which the research is to be performed as well as applicable international norms and standards but these must not be allowed to reduce or eliminate any of the protections for research subjects set forth in this Declaration.
The committee must have the right to monitor ongoing studies. The researcher must provide monitoring information to the committee, especially information about any serious adverse events. No amendment to the protocol may be made without consideration and approval by the committee. After the end of the study, the researchers must submit a final report to the committee containing a summary of the study's findings and conclusions.

Privacy and Confidentiality
24. Every precaution must be taken to protect the privacy of research subjects and the confidentiality of their personal information

Informed Consent
25. Participation by individuals capable of giving informed consent as subjects in medical research must be voluntary. Although it may be appropriate to consult family members or community leaders, no individual capable of giving informed consent may be enrolled in a research study unless he or she freely agrees.
26. In medical research involving human subjects capable of giving informed consent, each potential subject must be adequately informed of the aims, methods, sources of funding, any possible conflicts of interest, institutional affiliations of the researcher, the anticipated benefits and potential risks of the study and the discomfort it may entail, post-study provisions and any other relevant aspects of the study. The potential subject must be informed of the right to refuse to participate in the study or to withdraw consent to participate at any time without reprisal. Special attention should be given to the specific information needs of individual potential subjects as well as to the methods used to deliver the information.
After ensuring that the potential subject has understood the information, the physician or another appropriately qualified individual must then seek the potential subject's freely-given informed consent, preferably in writing. If the consent cannot be expressed in writing, the non-written consent must be formally documented and witnessed.

All medical research subjects should be given the option of being informed about the general outcome and results of the study.

27. When seeking informed consent for participation in a research study the physician must be particularly cautious if the potential subject is in a dependent relationship with the physician or may consent under duress. In such situations the informed consent must be sought by an appropriately qualified individual who is completely independent of this relationship.
28. For a potential research subject who is incapable of giving informed consent, the physician must seek informed consent from the legally authorised representative. These individuals must not be included in a research study that has no likelihood of benefit for them unless it is intended to promote the health of the group represented by the potential subject, the research cannot instead be performed with persons capable of providing informed consent, and the research entails only minimal risk and minimal burden.
29. When a potential research subject who is deemed incapable of giving informed consent is able to give assent to decisions about participation in research, the physician must seek that assent in addition to the consent of the legally authorised representative. The potential subject's dissent should be respected.
30. Research involving subjects who are physically or mentally incapable of giving consent, for example, unconscious patients, may be done only if the physical or mental condition that prevents giving informed consent is a necessary characteristic of the research group. In such circumstances the physician must seek informed consent from the legally authorised representative. If no such representative is available and if the research cannot be delayed, the study may proceed without informed consent provided that the specific reasons for involving subjects with a condition that renders them unable to give informed consent have been stated in the research protocol and the study has been approved by a research ethics committee. Consent to remain in the research must be obtained as soon as possible from the subject or a legally authorised representative.
31. The physician must fully inform the patient which aspects of their care are related to the research. The refusal of a patient to participate in a study or the patient's decision to withdraw from the study must never adversely affect the patient-physician relationship.
32. For medical research using identifiable human material or data, such as research on material or data contained in biobanks or similar repositories, physicians must seek informed consent for its collection, storage and/or reuse. There may be exceptional situations where consent would be impossible or impracticable to obtain for such research. In such situations the research may be done only after consideration and approval of a research ethics committee.

Use of Placebo
33. The benefits, risks, burdens and effectiveness of a new intervention must be tested against those of the best proven intervention(s), except in the following circumstances:
Where no proven intervention exists, the use of placebo, or no intervention, is acceptable; or

Where for compelling and scientifically sound methodological reasons the use of any intervention less effective than the best proven one, the use of placebo, or no intervention is necessary to determine the efficacy or safety of an intervention

and the patients who receive any intervention less effective than the best proven one, placebo, or no intervention will not be subject to additional risks of serious or irreversible harm as a result of not receiving the best proven intervention.

Extreme care must be taken to avoid abuse of this option.

Post-Trial Provisions
34. In advance of a clinical trial, sponsors, researchers and host country governments should make provisions for post-trial access for all participants who still need an intervention identified as beneficial in the trial. This information must also be disclosed to participants during the informed consent process.

Research Registration and Publication and Dissemination of Results
35. Every research study involving human subjects must be registered in a publicly accessible database before recruitment of the first subject.
36. Researchers, authors, sponsors, editors and publishers all have ethical obligations with regard to the publication and dissemination of the results of research. Researchers have a duty to make publicly available the results of their research on human subjects and are accountable for the completeness and accuracy of their reports. All parties should adhere to accepted guidelines for ethical reporting. Negative and inconclusive as well as positive results must be published or otherwise made publicly available. Sources of funding, institutional affiliations and conflicts of interest must be declared in the publication. Reports of research not in accordance with the principles of this Declaration should not be accepted for publication.

Unproven Interventions in Clinical Practice
37. In the treatment of an individual patient, where proven interventions do not exist or other known interventions have been ineffective, the physician, after seeking expert advice, with informed consent from the patient or a legally authorised representative, may use an unproven intervention if in the physician's judgement it offers hope of saving life, re-establishing health or alleviating suffering. This intervention should subsequently be made the object of research, designed to evaluate its safety and efficacy. In all cases, new information must be recorded and, where appropriate, made publicly available.

序文
1. 世界医師会(WMA)は、特定できる人間由来の試料およびデータの研究を含む、人間を対象とする医学研究の倫理的原則の文書としてヘルシンキ宣言を改訂してきた。
本宣言は全体として解釈されることを意図したものであり、各項目は他のすべての関連項目を考慮に入れて適用されるべきである。

2. WMAの使命の一環として、本宣言は主に医師に対して表明されたものである。WMAは人間を対象とする医学研究に関与する医師以外の人々に対してもこれらの諸原則の採用を推奨する。

一般原則
3. WMAジュネーブ宣言は、「私の患者の健康を私の第一の関心事とする」ことを医師に義務づけ、また医の国際倫理綱領は、「医師は、医療の提供に際して、患者の最善の利益のために行動すべきである」と宣言している。
4. 医学研究の対象とされる人々を含め、患者の健康、福利、権利を向上させ守ることは医師の責務である。医師の知識と良心はこの責務達成のために捧げられる。
5. 医学の進歩は人間を対象とする諸試験を要する研究に根本的に基づくものである。
6. 人間を対象とする医学研究の第一の目的は、疾病の原因、発症および影響を理解し、予防、診断ならびに治療(手法、手順、処置)を改善することである。最善と証明された治療であっても、安全性、有効性、効率性、利用可能性および質に関する研究を通じて継続的に評価されなければならない。
7. 医学研究はすべての被験者に対する配慮を推進かつ保証し、その健康と権利を擁護するための倫理基準に従わなければならない。
8. 医学研究の主な目的は新しい知識を得ることであるが、この目標は個々の被験者の権利および利益に優先することがあってはならない。
9. 被験者の生命、健康、尊厳、全体性、自己決定権、プライバシーおよび個人情報の秘密を守ることは医学研究に関与する医師の責務である。被験者の保護責任は常に医師またはその他の医療専門職にあり、被験者が同意を与えた場合でも、決してその被験者に移ることはない。
10. 医師は、適用される国際的規範および基準はもとより人間を対象とする研究に関する自国の倫理、法律、規制上の規範ならびに基準を考慮しなければならない。国内的または国際的倫理、法律、規制上の要請がこの宣言に示されている被験者の保護を減じあるいは排除してはならない。
11. 医学研究は、環境に害を及ぼす可能性を最小限にするよう実施されなければならない。
12. 人間を対象とする医学研究は、適切な倫理的および科学的な教育と訓練を受けた有資格者によってのみ行われなければならない。患者あるいは健康なボランティアを対象とする研究は、能力と十分な資格を有する医師またはその他の医療専門職の監督を必要とする。
13. 医学研究から除外されたグループには研究参加への機会が適切に提供されるべきである。
14. 臨床研究を行う医師は、研究が予防、診断または治療する価値があるとして正当化できる範囲内にあり、かつその研究への参加が被験者としての患者の健康に悪影響を及ぼさないことを確信する十分な理由がある場合に限り、その患者を研究に参加させるべきである。
15. 研究参加の結果として損害を受けた被験者に対する適切な補償と治療が保証されなければならない。

リスク、負担、利益
16. 医療および医学研究においてはほとんどの治療にリスクと負担が伴う。
人間を対象とする医学研究は、その目的の重要性が被験者のリスクおよび負担を上まわる場合に限り行うことができる。

17. 人間を対象とするすべての医学研究は、研究の対象となる個人とグループに対する予想し得るリスクおよび負担と被験者およびその研究によって影響を受けるその他の個人またはグループに対する予見可能な利益とを比較して、慎重な評価を先行させなければならない。
リスクを最小化させるための措置が講じられなければならない。リスクは研究者によって継続的に監視、評価、文書化されるべきである。

18. リスクが適切に評価されかつそのリスクを十分に管理できるとの確信を持てない限り、医師は人間を対象とする研究に関与してはならない。
潜在的な利益よりもリスクが高いと判断される場合または明確な成果の確証が得られた場合、医師は研究を継続、変更あるいは直ちに中止すべきかを判断しなければならない。

社会的弱者グループおよび個人
19. あるグループおよび個人は特に社会的な弱者であり不適切な扱いを受けたり副次的な被害を受けやすい。
すべての社会的弱者グループおよび個人は個別の状況を考慮したうえで保護を受けるべきである。

20. 研究がそのグループの健康上の必要性または優先事項に応えるものであり、かつその研究が社会的弱者でないグループを対象として実施できない場合に限り、社会的弱者グループを対象とする医学研究は正当化される。さらに、そのグループは研究から得られた知識、実践または治療からの恩恵を受けるべきである。

科学的要件と研究計画書
21. 人間を対象とする医学研究は、科学的文献の十分な知識、その他関連する情報源および適切な研究室での実験ならびに必要に応じた動物実験に基づき、一般に認知された科学的諸原則に従わなければならない。研究に使用される動物の福祉は尊重されなければならない。
22. 人間を対象とする各研究の計画と実施内容は、研究計画書に明示され正当化されていなければならない。
研究計画書には関連する倫理的配慮について明記され、また本宣言の原則がどのように取り入れられてきたかを示すべきである。計画書は、資金提供、スポンサー、研究組織との関わり、起こり得る利益相反、被験者に対する報奨ならびに研究参加の結果として損害を受けた被験者の治療および/または補償の条項に関する情報を含むべきである。

臨床試験の場合、この計画書には研究終了後条項についての必要な取り決めも記載されなければならない。

研究倫理委員会
23. 研究計画書は、検討、意見、指導および承認を得るため研究開始前に関連する研究倫理委員会に提出されなければならない。この委員会は、その機能において透明性がなければならず、研究者、スポンサーおよびその他いかなる不適切な影響も受けず適切に運営されなければならない。委員会は、適用される国際的規範および基準はもとより、研究が実施される国または複数の国の法律と規制も考慮しなければならない。しかし、そのために本宣言が示す被験者に対する保護を減じあるいは排除することを許してはならない。
研究倫理委員会は、進行中の研究をモニターする権利を持たなければならない。研究者は、委員会に対してモニタリング情報とくに重篤な有害事象に関する情報を提供しなければならない。委員会の審議と承認を得ずに計画書を修正してはならない。研究終了後、研究者は研究知見と結論の要約を含む最終報告書を委員会に提出しなければならない。

プライバシーと秘密保持
24. 被験者のプライバシーおよび個人情報の秘密保持を厳守するためあらゆる予防策を講じなければならない。

インフォームド・コンセント
25. 医学研究の被験者としてインフォームド・コンセントを与える能力がある個人の参加は自発的でなければならない。家族または地域社会のリーダーに助言を求めることが適切な場合もあるが、インフォームド・コンセントを与える能力がある個人を本人の自主的な承諾なしに研究に参加させてはならない。
26. インフォームド・コンセントを与える能力がある人間を対象とする医学研究において、それぞれの被験者候補は、目的、方法、資金源、起こり得る利益相反、研究者の施設内での所属、研究から期待される利益と予測されるリスクならびに起こり得る不快感、研究終了後条項、その他研究に関するすべての面について十分に説明されなければならない。被験者候補は、いつでも不利益を受けることなしに研究参加を拒否する権利または参加の同意を撤回する権利があることを知らされなければならない。個々の被験者候補の具体的情報の必要性のみならずその情報の伝達方法についても特別な配慮をしなければならない。
被験者候補がその情報を理解したことを確認したうえで、医師またはその他ふさわしい有資格者は被験者候補の自主的なインフォームド・コンセントをできれば書面で求めなければならない。同意が書面で表明されない場合、その書面によらない同意は立会人のもとで正式に文書化されなければならない。

医学研究のすべての被験者は、研究の全体的成果について報告を受ける権利を与えられるべきである。

27. 研究参加へのインフォームド・コンセントを求める場合、医師は、被験者候補が医師に依存した関係にあるかまたは同意を強要されているおそれがあるかについて特別な注意を払わなければならない。そのような状況下では、インフォームド・コンセントはこうした関係とは完全に独立したふさわしい有資格者によって求められなければならない。
28. インフォームド・コンセントを与える能力がない被験者候補のために、医師は、法的代理人からインフォームド・コンセントを求めなければならない。これらの人々は、被験者候補に代表されるグループの健康増進を試みるための研究、インフォームド・コンセントを与える能力がある人々では代替して行うことができない研究、そして最小限のリスクと負担のみ伴う研究以外には、被験者候補の利益になる可能性のないような研究対象に含まれてはならない。
29. インフォームド・コンセントを与える能力がないと思われる被験者候補が研究参加についての決定に賛意を表することができる場合、医師は法的代理人からの同意に加えて本人の賛意を求めなければならない。被験者候補の不賛意は、尊重されるべきである。
30. 例えば、意識不明の患者のように、肉体的、精神的にインフォームド・コンセント を与える能力がない被験者を対象とした研究は、インフォームド・コンセントを与 えることを妨げる肉体的・精神的状態がその研究対象グループに固有の症状となっ ている場合に限って行うことができる。このような状況では、医師は法的代理人か らインフォームド・コンセントを求めなければならない。そのような代理人が得ら れず研究延期もできない場合、この研究はインフォームド・コンセントを与えられ ない状態にある被験者を対象とする特別な理由が研究計画書で述べられ、研究倫理委員会で承認されていることを条件として、インフォームド・コンセントなしに開始することができる。研究に引き続き留まる同意はできるかぎり早く被験者または法的代理人から取得しなければならない。
31. 医師は、治療のどの部分が研究に関連しているかを患者に十分に説明しなければならない。患者の研究への参加拒否または研究離脱の決定が患者・医師関係に決して悪影響を及ぼしてはならない。
32. バイオバンクまたは類似の貯蔵場所に保管されている試料やデータに関する研究など、個人の特定が可能な人間由来の試料またはデータを使用する医学研究のためには、医師は収集・保存および/または再利用に対するインフォームド・コンセントを求めなければならない。このような研究に関しては、同意を得ることが不可能か実行できない例外的な場合があり得る。このような状況では研究倫理委員会の審議と承認を得た後に限り研究が行われ得る。

プラセボの使用
33. 新しい治療の利益、リスク、負担および有効性は、以下の場合を除き、最善と証明されている治療と比較考量されなければならない:
証明された治療が存在しない場合、プラセボの使用または無治療が認められる;あるいは、説得力があり科学的に健全な方法論的理由に基づき、最善と証明されたものより効果が劣る治療、プラセボの使用または無治療が、その治療の有効性あるいは安全性を決定するために必要な場合、

そして、最善と証明されたものより効果が劣る治療、プラセボの使用または無治療の患者が、最善と証明された治療を受けなかった結果として重篤または回復不能な損害の付加的リスクを被ることがないと予想される場合。

この選択肢の乱用を避けるため徹底した配慮がなされなければならない。

研究終了後条項
34. 臨床試験の前に、スポンサー、研究者および主催国政府は、試験の中で有益であると証明された治療を未だ必要とするあらゆる研究参加者のために試験終了後のアクセスに関する条項を策定すべきである。また、この情報はインフォームド・コンセントの手続きの間に研究参加者に開示されなければならない。

研究登録と結果の刊行および普及
35. 人間を対象とするすべての研究は、最初の被験者を募集する前に一般的にアクセス可能なデータベースに登録されなければならない。
36. すべての研究者、著者、スポンサー、編集者および発行者は、研究結果の刊行と普及に倫理的責務を負っている。研究者は、人間を対象とする研究の結果を一般的に公表する義務を有し報告書の完全性と正確性に説明責任を負う。すべての当事者は、倫理的報告に関する容認されたガイドラインを遵守すべきである。否定的結果および結論に達しない結果も肯定的結果と同様に、刊行または他の方法で公表されなければならない。資金源、組織との関わりおよび利益相反が、刊行物の中には明示されなければならない。この宣言の原則に反する研究報告は、刊行のために受理されるべきではない。

臨床診療における未実証の治療
37. 個々の患者の処置において証明された治療が存在しないかまたはその他の既知の治療が有効でなかった場合、患者または法的代理人からのインフォームド・コンセントがあり、専門家の助言を求めたうえ、医師の判断において、その治療で生命を救う、健康を回復するまたは苦痛を緩和する望みがあるのであれば、証明されていない治療を実施することができる。この治療は、引き続き安全性と有効性を評価するために計画された研究の対象とされるべきである。すべての事例において新しい情報は記録され、適切な場合には公表されなければならない。

PREAMBLE
The relationship between physicians, their patients and broader society has undergone significant changes in recent times. While a physician should always act according to his/her conscience, and always in the best interests of the patient, equal effort must be made to guarantee patient autonomy and justice. The following Declaration represents some of the principal rights of the patient that the medical profession endorses and promotes. Physicians and other persons or bodies involved in the provision of health care have a joint responsibility to recognize and uphold these rights. Whenever legislation, government action or any other administration or institution denies patients these rights, physicians should pursue appropriate means to assure or to restore them.
PRINCIPLES
1. Right to medical care of good quality
a. Every person is entitled without discrimination to appropriate medical care.
b. Every patient has the right to be cared for by a physician whom he/she knows to be free to make clinical and ethical judgements without any outside interference.
c. The patient shall always be treated in accordance with his/her best interests. The treatment applied shall be in accordance with generally approved medical principles.
d. Quality assurance should always be a part of health care. Physicians, in particular, should accept responsibility for being guardians of the quality of medical services.
e. In circumstances where a choice must be made between potential patients for a particular treatment that is in limited supply, all such patients are entitled to a fair selection procedure for that treatment. That choice must be based on medical criteria and made without discrimination.
f. The patient has the right to continuity of health care. The physician has an obligation to cooperate in the coordination of medically indicated care with other health care providers treating the patient. The physician may not discontinue treatment of a patient as long as further treatment is medically indicated, without giving the patient reasonable assistance and sufficient opportunity to make alternative arrangements for care.
2. Right to freedom of choice
a. The patient has the right to choose freely and change his/her physician and hospital or health service institution, regardless of whether they are based in the private or public sector.
b. The patient has the right to ask for the opinion of another physician at any stage. 17.H2
3. Right to self-determination
a. The patient has the right to self-determination, to make free decisions regarding himself/ herself. The physician will inform the patient of the consequences of his/her decisions.
b. A mentally competent adult patient has the right to give or withhold consent to any diagnostic procedure or therapy. The patient has the right to the information necessary to make his/her decisions. The patient should understand clearly what is the purpose of any test or treatment, what the results would imply, and what would be the implications of withholding consent.
c. The patient has the right to refuse to participate in research or the teaching of medicine.
4. The unconscious patient
a. If the patient is unconscious or otherwise unable to express his/her will, informed consent must be obtained whenever possible, from a legally entitled representative.
b. If a legally entitled representative is not available, but a medical intervention is urgently needed, consent of the patient may be presumed, unless it is obvious and beyond any doubt on the basis of the patient's previous firm expression or conviction that he/she would refuse consent to the intervention in that situation.
c. However, physicians should always try to save the life of a patient unconscious due to a suicide attempt.
5. The legally incompetent patient
a. If a patient is a minor or otherwise legally incompetent, the consent of a legally entitled representative is required in some jurisdictions. Nevertheless the patient must be involved in the decision-making to the fullest extent allowed by his/her capacity.
b. If the legally incompetent patient can make rational decisions, his/her decisions must be respected, and he/she has the right to forbid the disclosure of information to his/her legally entitled representative.
c. If the patient's legally entitled representative, or a person authorized by the patient, forbids treatment which is, in the opinion of the physician, in the patient's best interest, the physician should challenge this decision in the relevant legal or other institution. In case of emergency, the physician will act in the patient's best interest.
6. Procedures against the patient's will
Diagnostic procedures or treatment against the patient's will can be carried out only in exceptional cases, if specifically permitted by law and conforming to the principles of medical ethics.
7. Right to information
a. The patient has the right to receive information about himself/herself recorded in any of his/her medical records, and to be fully informed about his/her health status including the medical facts about his/her condition. However, confidential information in the patient's records about a third party should not be given to the patient without the consent of that third party.
b. Exceptionally, information may be withheld from the patient when there is good reason to believe that this information would create a serious hazard to his/her life or health.
c. Information should be given in a way appropriate to the patient’s culture and in such a way that the patient can understand.
d. The patient has the right not to be informed on his/her explicit request, unless required for the protection of another person's life.
e. The patient has the right to choose who, if anyone, should be informed on his/her behalf.
8. Right to confidentiality
a. All identifiable information about a patient's health status, medical condition, diagnosis, prognosis and treatment and all other information of a personal kind must be kept confidential, even after death. Exceptionally, descendants may have a right of access to information that would inform them of their health risks.
b. Confidential information can only be disclosed if the patient gives explicit consent or if expressly provided for in the law. Information can be disclosed to other health care providers only on a strictly "need to know" basis unless the patient has given explicit consent.
c. All identifiable patient data must be protected. The protection of the data must be appropriate to the manner of its storage. Human substances from which identifiable data can be derived must be likewise protected.
9. Right to Health Education
Every person has the right to health education that will assist him/her in making informed choices about personal health and about the available health services. The education should include information about healthy lifestyles and about methods of prevention and early detection of illnesses. The personal responsibility of everybody for his/her own health should be stressed. Physicians have an obligation to participate actively in educational efforts.
10. Right to dignity
a. The patient's dignity and right to privacy shall be respected at all times in medical care and teaching, as shall his/her culture and values.
b. The patient is entitled to relief of his/her suffering according to the current state of knowledge.
c. The patient is entitled to humane terminal care and to be provided with all available assistance in making dying as dignified and comfortable as possible.
11. Right to religious assistance
The patient has the right to receive or to decline spiritual and moral comfort including the help of a minister of his/her chosen religion.

序 文
医師、患者およびより広い意味での社会との関係は、近年著しく変化してきた。医師は、常に自らの良心に従い、また常に患者の最善の利益のために行動すべきであると同時に、それと同等の努力を患者の自律性と正義を保証するために払わねばならない。以下に掲げる宣言は、医師が是認し推進する患者の主要な権利のいくつかを述べたものである。医師および医療従事者、または医療組織は、この権利を認識し、擁護していくうえで共同の責任を担っている。法律、政府の措置、あるいは他のいかなる行政や慣例であろうとも、患者の権利を否定する場合には、医師はこの権利を保障ないし回復させる適切な手段を講じるべきである。

原則

1.良質の医療を受ける権利
a. すべての人は、差別なしに適切な医療を受ける権利を有する。
b. すべての患者は、いかなる外部干渉も受けずに自由に臨床上および倫理上の判断を行うことを認識している医師から治療を受ける権利を有する。
c. 患者は、常にその最善の利益に即して治療を受けるものとする。患者が受ける治療は、一般的に受け入れられた医学的原則に沿って行われるものとする。
d. 質の保証は、常に医療のひとつの要素でなければならない。特に医師は、医療の質の擁護者たる責任を担うべきである。
e. 供給を限られた特定の治療に関して、それを必要とする患者間で選定を行わなければならない場合は、そのような患者はすべて治療を受けるための公平な選択手続きを受ける権利がある。その選択は、医学的基準に基づき、かつ差別なく行われなければならない。
f. 患者は、医療を継続して受ける権利を有する。医師は、医学的に必要とされる治療を行うにあたり、同じ患者の治療にあたっている他の医療提供者と協力する責務を有する。医師は、現在と異なる治療を行うために患者に対して適切な援助と十分な機会を与えることができないならば、今までの治療が医学的に引き続き必要とされる限り、患者の治療を中断してはならない。

2.選択の自由の権利
a. 患者は、民間、公的部門を問わず、担当の医師、病院、あるいは保健サービス機関を自由に選択し、また変更する権利を有する。
b. 患者はいかなる治療段階においても、他の医師の意見を求める権利を有する。

3.自己決定の権利
a. 患者は、自分自身に関わる自由な決定を行うための自己決定の権利を有する。医師は、患者に対してその決定のもたらす結果を知らせるものとする。
b. 精神的に判断能力のある成人患者は、いかなる診断上の手続きないし治療に対しても、同意を与えるかまたは差し控える権利を有する。患者は自分自身の決定を行ううえで必要とされる情報を得る権利を有する。患者は、検査ないし治療の目的、その結果が意味すること、そして同意を差し控えることの意味について明確に理解するべきである。
c. 患者は医学研究あるいは医学教育に参加することを拒絶する権利を有する。

4.意識のない患者
a. 患者が意識不明かその他の理由で意思を表明できない場合は、法律上の権限を有する代理人から、可能な限りインフォームド・コンセントを得なければならない。
b. 法律上の権限を有する代理人がおらず、患者に対する医学的侵襲が緊急に必要とされる場合は、患者の同意があるものと推定する。ただし、その患者の事前の確固たる意思表示あるいは信念に基づいて、その状況における医学的侵襲に対し同意を拒絶することが明白かつ疑いのない場合を除く。
c. しかしながら、医師は自殺企図により意識を失っている患者の生命を救うよう常に努力すべきである。

5.法的無能力の患者
a. 患者が未成年者あるいは法的無能力者の場合、法域によっては、法律上の権限を有する代理人の同意が必要とされる。それでもなお、患者の能力が許す限り、患者は意思決定に関与しなければならない。
b. 法的無能力の患者が合理的な判断をしうる場合、その意思決定は尊重されねばならず、かつ患者は法律上の権限を有する代理人に対する情報の開示を禁止する権利を有する。
c. 患者の代理人で法律上の権限を有する者、あるいは患者から権限を与えられた者が、医師の立場から見て、患者の最善の利益となる治療を禁止する場合、医師はその決定に対して、関係する法的あるいはその他慣例に基づき、異議を申し立てるべきである。救急を要する場合、医師は患者の最善の利益に即して行動することを要する。

6.患者の意思に反する処置
患者の意思に反する診断上の処置あるいは治療は、特別に法律が認めるか医の倫理の諸原則に合致する場合には、例外的な事例としてのみ行うことができる。

7.情報に対する権利
a. 患者は、いかなる医療上の記録であろうと、そこに記載されている自己の情報を受ける権利を有し、また症状についての医学的事実を含む健康状態に関して十分な説明を受ける権利を有する。しかしながら、患者の記録に含まれる第三者についての機密情報は、その者の同意なくしては患者に与えてはならない。
b. 例外的に、情報が患者自身の生命あるいは健康に著しい危険をもたらす恐れがあると信ずるべき十分な理由がある場合は、その情報を患者に対して与えなくともよい。
c. 情報は、その患者の文化に適した方法で、かつ患者が理解できる方法で与えられなければならない。
d. 患者は、他人の生命の保護に必要とされていない場合に限り、その明確な要求に基づき情報を知らされない権利を有する。
e. 患者は、必要があれば自分に代わって情報を受ける人を選択する権利を有する。

8.守秘義務に対する権利
a. 患者の健康状態、症状、診断、予後および治療について個人を特定しうるあらゆる情報、ならびにその他個人のすべての情報は、患者の死後も秘密が守られなければならない。ただし、患者の子孫には、自らの健康上のリスクに関わる情報を得る権利もありうる。
b. 秘密情報は、患者が明確な同意を与えるか、あるいは法律に明確に規定されている場合に限り開示することができる。情報は、患者が明らかに同意を与えていない場合は、厳密に「知る必要性」 に基づいてのみ、他の医療提供者に開示することができる。
c. 個人を特定しうるあらゆる患者のデータは保護されねばならない。データの保護のために、その保管形態は適切になされなければならない。個人を特定しうるデータが導き出せるようなその人の人体を形成する物質も同様に保護されねばならない。

9.健康教育を受ける権利
すべての人は、個人の健康と保健サービスの利用について、情報を与えられたうえでの選択が可能となるような健康教育を受ける権利がある。この教育には、健康的なライフスタイルや、疾病の予防および早期発見についての手法に関する情報が含まれていなければならない。健康に対するすべての人の自己責任が強調されるべきである。医師は教育的努力に積極的に関わっていく義務がある。

10.尊厳に対する権利
a. 患者は、その文化および価値観を尊重されるように、その尊厳とプライバシーを守る権利は、医療と医学教育の場において常に尊重されるものとする。
b. 患者は、最新の医学知識に基づき苦痛を緩和される権利を有する。
c. 患者は、人間的な終末期ケアを受ける権利を有し、またできる限り尊厳を保ち、かつ安楽に死を迎えるためのあらゆる可能な助力を与えられる権利を有する。

11.宗教的支援に対する権利
患者は、信仰する宗教の聖職者による支援を含む、精神的、道徳的慰問を受けるか受けないかを決める権利を有する。

序 文
1. 医師は、患者に対して、専門職としての医療を提供するよう努めている。患者の安全は、保健医療における質の中核的要素のひとつである。
2. 医学および関連科学技術の進歩によって、現代医学は高度で複雑な医療システムの上に成り立つこととなった。
3. 臨床医学は本来的にリスクを抱えるものである。現代医学の発展は新たな、そして時にはより大きなリスク―避け得るものやその他不可避的なもの―を生む結果となった。
4. 医師は、これらのリスクを予見し、患者の治療のなかでそれらを管理するよう努めるべきである。
原 則
5. 医師は、医療上の意思決定にあたっては常に患者の安全を確保しなければならない。
6. 一個人ないしひとつの過程だけが原因でエラーが起ることはまれである。むしろ、別々の要素が結びつき、それらがいっしょになってハイリスクの状態を作り出すのである。それゆえ、ヘルス・ケアでのエラーを極秘に報告するための非懲罰的な環境が必要であり、これによりシステムの欠陥を予防し改善し、個人や組織の過失にしないようにするべきである。
7. 現代医療に内在するリスクの現実を踏まえると、医師は、医療専門職という立場を超えて、患者を含むすべての関係者と協力して、患者の安全のために、プロアクティブ・システムズ・アプローチに取り組まなければならない。
8. 組織的アプローチを構築するためには、医師は、絶えず、一連の最新科学的知識を吸収し、実地医療を恒常的に進化させるよう努力しなければならない。
9. 患者の安全に関わるすべての情報は、患者を含むすべての関係者と共有しなければならない。同時に、患者の秘密は厳密に保持されなくてはならない。
勧 告
10. それゆえWMAは各国医師会に以下のとおり勧告する。
10.1 各国医師会は、自国のすべての医師に対して患者の安全に関する方策を促進すべきである。
10.2 各国医師会は、個々の医師、その他ヘルスケア専門家、患者およびその他の関連の個人や組織に対し、患者の安全を確保するために必要なシステムを構築するよう協力することを奨励すべきである。
10.3 各国医師会は、生涯教育/専門能力開発によって、患者の安全を促進する効果的なモデルを形成するよう啓発に努めなくてはならない。
10.4 各国医師会は互いに協力して、患者の安全を向上するためにエラーを含む有害事象、その解決方法、そして「学んだ教訓」についての情報を交換するよう努めなければならない。

当院では、診療録・電子媒体による保存のために使用される機器、ソフトウェア及び運用に必要な仕組み全般の電子保存に関する法令及びその他の規範を守り、お客様の大事な個人情報保護に万全を期すことをここに表明します。

目的:この規定は、当院で法令により保存する義務が規定されている、診療録及び診療所記録の電子媒体による保存用に使われる機器、ソフトウェア及び運用に必要な仕組みについて、取り扱いや管理に関する事項をここに定め、保存する義務のある情報を適正に保存利用することを目的としている。

電子保存に関する理念:保存する義務のある情報の電子端末による保存が、自己責任の理念に則って行われることを、電子保存システムの管理者及び利用者は適正に理解しておかなければならない。また、電子保存システムの管理者及び運営者は、電子端末に保存された情報の正しさ、見やすさ、安全な状況下での保存を確保し、情報が患者の診療や診療所の運営上必要とされるときに、信頼できる情報を迅速に提供できるように協力して適正な運営に努め、電子端末に保存することによって患者のプライパシーが侵害されることのないように注意しなくてはならない。

電子端末による保存(電子保存)による情報の範囲:当院において電子保存の対象とする診療情報は診療録、調剤録、放射線写真(XP及びCT画像)、超音波検査画像、臨床検査報告、聴力検査、重心同様計測装置、各種画像、紙媒体の報告書等の診療記録の内、デジタル化が可能である情報に限られる。

管理組織:当院理事長の大場俊彦を電子保存システム管理者として設置し、理事長は必要な場合、システム管理者を別に指名することが可能である。

システム管理者の責務:システム管理者は以下の責務を負う。
電子保存に用いる機器及びソフトウェアを導入するに当たって、システムの機能を確認し、これらが厚生労働省「医療情報システムの安全管理に関するガイドライン第5版(平成29年5月)」に掲載されている各項目に一致するよう留意すること。システムの機能要件にあたる機能が、差し障りなく運用される環境を維持するように努めること。機器やソフトウェアを変更した場合でも、電子保存された情報を継続して使用できるように維持すること。不正利用を防ぐため、電子保存システムを利用する職員の登録を管理してアクセス権を規定し、正しい利用のために教育と訓練を行うこと。

電子保存システム利用者の責務: 電子保存システム利用者は、以下の責務を負う。暗証番号・パスワードを管理し、他者の利用を防ぐこと。電子保存システムへの、情報の参照や入力等のアクセスに対して、認証番号やパスワードを設定してシステムにシステム利用者自身を認識させること。 電子保存システムへの情報入力に対して、入力方法が正しいことを確認する確定操作を行い、システム利用者の責任を明示すること。与えられたアクセス権限を越権するような操作を行わないこと。 参照した情報を、規定の目的以外に利用しないこと。患者のプライパシーをみだりに侵害しないこと。

システムの機能要件: 電子保存システムは、次の機能を完備するものとする。情報にアクセスする者への識別認証を行う機能、機密情報の段階に応じたシステム利用者のアクセス権限の設定。不正アクセスを排除する機能、システム利用者の入力情報に対して確定操作を行い、その情報を保存できる機能。システム利用者が確定操作を行った情報記録の更新に伴い、これらの情報に関連して記録する機能。記録されている情報を、管理上及び診療上必要になった場合、迅速に出力する機能。情報の利用範囲等に応じて管理設定できる機能。システム利用者のアクセス情報を保存し、調査できる機能。記録された情報のバックアップを作成する機能。

機器の管理: 電子保存システムの設置場所は常に施錠等のセキュリティで保護し、システム管理者の指示がない限り、他の職員・外部の者などの第三者が操作できないようにする。設置機器は定期的に点検し、電子保存システムを火災・災害等にも対応可能できるよう設備や装置を整えておく。

記録媒体の管理:記録媒体は、記録した情報が保護されるよう、別の媒体にも補助的に記録しておく。 品質の劣化が予想される媒体な場合は、予め他の媒体で複写をとる。

ソフトウェアの管理:システム管理者は電子保存システムにおいて使われるソフトウェアを使用前に検査して情報の安全性に支障がないことを確認。また定期的に異常の有無を検査し、万全の状態で稼働させられるようにする。

管理記録の整備:システム管理者は電子保存システムの取り扱いについて熟知してシステム利用者にその存在を周知させた後、常時利用が可能な状態に設置。システム管理者は規定に定められた電子保存システムの管理を行い、電子保存システムを保存する。
教育と訓練:システム管理者はシステムを利用する職員に対して、情報の安全性とプライパシーの保護に関する教育・研修の機会を設ける。

その他:この規定に定めている他の必要事項を乗せる場合が生じた場合は、システム管理者である理事長がこれを定める。
